A story of Due Diligence submitted by Richard Ortiz of Courthouse Research Specialists.

Part of rebuilding New Orleans caused residents often to be challenged with the task of tracing home titles back potentially hundreds of years. With a community rich with history stretching back over two centuries, houses have been passed along through generations of family, sometimes making it quite difficult to establish ownership. Here's a great letter an attorney wrote to the FHA on behalf of a client:


You have to love this lawyer........


A New Orleans lawyer sought an FHA loan for a client.
He was told the loan would be granted if he could prove
satisfactory title to a parcel of property being offered as
collateral. The title to the property dated back to 1803,
which took the lawyer three months to track down. After
sending the information to the FHA, he received the
following reply.

(Actual reply from FHA):
"Upon review of your letter adjoining your client's loan
application, we note that the request is supported by an
Abstract of Title. While we compliment the able manner in which you have prepared and presented the application, we must point out that you have only cleared title to the proposed collateral property back to 1803. Before final approval can be accorded, it will be necessary to clear the title back to its origin."


Annoyed, the lawyer responded as follows:
(Actual response):

"Your letter regarding title in Case No.189156 has been received.
I note that you wish to have title extended further than the 206 years covered by the present application. I was unaware that any educated person in this country, particularly those working in the property area, would not know that Louisiana was purchased by the United States from France in 1803, the year of origin identified in our application. For the edification of uninformed FHA bureaucrats, the title to the land prior to U.S. ownership was obtained from France, which had acquired it by Right of Conquest from Spain. The land
came into the possession of Spain by Right of Discovery made in the year 1492 by a sea captain named Christopher Columbus, who had been granted the privilege of seeking a new route to India by the Spanish monarch, Queen Isabella. The good Queen Isabella, being a pious woman and almost as careful about titles as the FHA, took the precaution of securing the blessing of the Pope before she sold her jewels to finance Columbus's expedition.
Now the Pope, as I'm sure you may know, is the emissary of Jesus Christ, the Son of God, and God, it is commonly accepted, created this world. Therefore, I believe it is safe to presume that God also made that part of the world called Louisiana . God, therefore, would be the owner of origin and His origins date back to before the beginning of time, the world as we know it, and the FHA. I hope you find God's original claim to be satisfactory.
Now, may we have our loan?"

The loan was immediately approved

In the Rearview Mirror…

--- Another strong turnout for the monthly Chapter meeting in July.  Gordon Perry of SAM, Inc. came up from Austin to give a eyepopping presentation on one of the newest technologies being utilized in the geospatial world…..mobile mapping  Lively discussion followed the presentation.  50 attendees.

 

---Vaya con Dios to Charlie Redd…Long time Chapter 5 member and present Chapter Director Charlie Redd informed Chapter President Raul Wong recently that Charlie and his wife are relocating to the Hill Country, to the west of San Antonio.  Although Charlie won’t always be In our midst, we have a feeling he may drop us a line on his whereabouts and doings.  Best luck to Charlie!

 

---Flower Mound High School student takes 2nd Place in National Trig*Star Event…

Recently graduated Tyler Fugere of Flower Mound High School (Lewisville ISD) placed second in the National Trig*star event.  Tyler was the Texas state winner, and recently was honored at the June Chapter 5 meeting as the local Chapter 5 area winner.  For the National event, Tyler was one of 34 competitors.  His plans are to attend Texas A&M this fall.  John Pierce oversees the Trig*Star activities for Chapter 5.

 

---TSPS Geocache Update, submitted by Charlie Redd

Update on the TSPS Geocache site at the Texas Ranger Hall of Fame Museum in Waco: Click Here for a map showing the counties the TSPS Ranger Star “travelbug" has visited since March of 2009. This one was asked to visit all the counties in Texas; it has traveled to 14 counties hitting some more than once. With 254 counties in our great State, it has several left to visit. To date it has traveled over 1,300 miles (1,303.6 miles to be exact).  It is presently hiding out in Lamar County waiting for someone to pick it up.

Our second travelbug is marked missing after finding its way up to Wyoming; it had several adventures along the way that can be read in the log of events.  Those folks who have been in contact with the TSPS geocaches have had fun with our Texas Surveyor related travelbugs.

 

---2010 Teachers Retreat Financials…while not “official”, it appears the financial cost to Chapter 5 for co sponsoring the 2010 Educator’s Retreat at North Lake College with Chapter 2 will be about $1,500.00.  Additionally, there is about $4,000.00 that was donated to the TSPS office for the Retreat, and the Retreat Organizing Committee recently voted to put forth a motion at the upcoming TSPS Board Meeting in Frisco (Aug. 21) that those funds be “set aside for the use by Chapters 2 and 5 for additional local Retreat events within the next 3 years”.  We’ll see where that goes!

 

---New TSPS website…our state association has recently undertaken efforts to upgrade and modernize the TSPS website in an effort to better serve members.  While still ongoing, when the dust settles it should offer everyone more resources and better communications.  Take a peek at www.tsps.org

    Opportunities for You….

     

     

    ---Chapter 5 Ballot for 2010-2011…a ballot has been prepared by the Nominating Committee and will soon be available for members to select their leaders for the upcoming year.  Voters will be asked to select a 2nd Vice president, as well as two new 2 Year Directors.  New Chapter Officer Installation will take place on Tuesday evening, September 14th, at the Cantina Laredo Restaurant, with incoming TSPS president John Watson doing the Installation.  Be sure to come out and share with this “changing of the guard”, as Chapter 5 continues onward as a leader among Chapters within TSPS.  We will not be jointly meeting with Chapter 2 for this event as we have in the past, as they have decided to have their own Installation.  Click here for a Chapter 5 Ballot.

     

    ---Certified Survey Technician test date set….the next scheduled exam date for any of the Certified Survey Technician levels has been scheduled for Saturday August 14th at the West Campus of North Lake College.  This certification program is a great way for your paraprofessional staff to document their skill levels, both for office and field personnel.  You can download a practice test on the NSPS website via the CST link:                           (www.nspsmo.org ).     TSPS Strategic Planning and Quarterly Board Meeting in Frisco…This year TSPS is holding its annual Strategic Planning event at the Embassy Suites Hotel and Convention Center in Frisco on Friday August 20th.  The event is held so TSPS leaders, Committee members, and interested members can gather, discuss ideas, develop plans, and set a course for the upcoming year, and beyond.  It is a wonderful opportunity to meet and get to know other professionals from across the State, and to work together to keep the association headed down the right path.  All are encouraged to participate.  And don’t forget that on Saturday August 21st the various committees will meet in the morning to go over their respective items and issues (Education, Standards, Ethics, GIS, Public Relations, SkillsUSA, etc.).  Input from members is vital, so try to come out and take part, your opinion and ideas are essential to the success of the association.  On Saturday afternoon, the TSPS Board of Directors will meet to conduct Society business in an open atmosphere, where again all members are welcome to attend and participate.  This is a great opportunity for Chapter 5 members to meet the TSPS leaders of today and tomorrow, work with other Surveyors to better the association, and see the outstanding work that takes place by Committees working on a variety of issues to benefit members.  Chapter 5 Representative Chris Freeman will be representing Chapter 5 at the Board Meeting.

     

    Skills USA/Duncanville High School Survey Program…Bart Burnett is anxious for the new school term because the Survey Program there has great expectations for the coming year.  The students and Bart want to “ramp it up” and take the program to a higher and more challenging level.  This is going to be a great opportunity for Chapter 5 members to continue to lead the SKILLS survey programs, both statewide, and now even nationwide.  More news is sure to follow, but this will be one of the greatest opportunities for Surveyors to influence the future of the profession, so strap on your boots, boys!

     

    Membership…a recent inquiry to the TSPS office in Austin revealed that there are currently 188 members in Dallas Chapter 5, down 31 from last year.  As renewals come around towards the end of the calendar year, make an effort to renew, and encourage your professional and paraprofessional staff to join, too.

     

    North Lake College Fall Semester Survey Courses….It’s not too early to start preparing your staff/employees to the opportunities for advanced education.  Several survey classes will be offered at the North Lake College- West Campus in the Fall.  These are college credit courses recognized by the TBPLS and transferrable to other university programs across the State of Texas.  Further, Dallas Chapter 5 has monies available to assist students with their textbook purchase.

     

      --Monthly Meeting Program/Speaker ideas?  If you have an idea regarding a Speaker or meeting Program, contact Program Committee Chairman Paul Mannel (817) 293-1914.  Good programs mean good attendance and greater activity.
